ELIGIBILITY: Sweepstakes is open only to persons who are legal residents of the 50 United States and District of Columbia (excluding Guam, Puerto Rico and all other unincorporated U.S. territories and possessions) who are at least 18 years of age or older and of legal age of majority in the jurisdiction in which they reside at the time of entry (“Entrant”). Sponsor and their respective affiliates, partners, distributors, retailers, sales representatives, advertising and promotion agencies, prize suppliers, officers, directors and employees, (“Promotion Entities”) and their immediate family members and/or those living in the same household of each are not eligible to enter or win. Final eligibility for the award of any prize is subject to eligibility verification and contingent upon compliance with these Official Rules and fulfilling all other requirements set forth herein. ENTRY PERIOD: The Rose Sweepstakes begins at 12:01am EST on September 4, 2022 and ends at 11:59pm EST on September 22, 2022. (“Entry Period”) No purchase is necessary.

HOW TO ENTER: (Note) Sponsor may also in its sole discretion, make online entries for Sweepstakes available on other websites or social media platforms, including websites that are not operated by Sponsor.
Online: During the Entry Period, you may enter Sweepstakes by visiting https://www.bookerybliss.com/category/sweepstakes. (the “Website”) to complete the entry form. Entrant must fully complete and submit all non–optional data requested on the online entry form to be eligible, including a valid email address, date of birth, mailing address (if applicable) or any other information Sponsor may require.

Social Networks: (IF APPLICABLE) During the Entry Period, you may enter (if applicable) by following BookeryBliss and following the instructions on the Sweepstakes post. The official social media accounts for the Sponsor can be found on Instagram, Facebook, and Twitter @bookerybliss.

Entry Restrictions: Limit one (1) entry per person, per email address for the duration of the Entry Period, regardless of method of entry. Multiple entrants are not permitted to share the same email address. Entries received from any person in excess of the stated limitation will be void. Sweepstakes entry must be made by the Entrant only. Any attempt by Entrant to obtain entries by using multiple/different email addresses, identities, registrations and log-ins, or any other method(s), will void all of that participant’s entries. Use of any automated system to participate in the Sweepstakes is strictly prohibited and will result in disqualification, and all entries submitted or received via such automated system will be void. All entries are subject to verification at any time. Proof of submission does not constitute proof of entry. Any attempt to tamper with the Website, entry process, operation of Sweepstakes, or violation of the Official Rules in any way will be disqualified. All entries become the property of Sponsor and will not be acknowledged or returned.  All Entries must be posted during the Entry Period in order to qualify.

Social Network Submission Guidelines: Comments and/or posts that are submitted on Social Networks (defined below) for the purpose of Sweepstakes (“Submission”) during the Entry Period constitutes acknowledgement of, and consent to these Official Rules. Entrants are prohibited from inaccurately tagging content in any Sweepstakes related comment or post and must comply with Social Networks terms of use. Entry times will be determined by the timestamp attributed to the entrant’s Submission by the social media platform used by the entrant to enter. The entrant must be the registered user of the social media account used to submit the Submission and able to receive private messages to enable Sponsor to communicate with potential winners. Entrants must comply with Social Networks terms of use and all other guidelines. Entries that contain offensive, obscene, violent, denigrating, racist, discriminatory, defamatory, illegal, threatening or insulting content will AUTOMATICALLY VOID ALL ENTRIES FROM THAT ENTRANT.

Authorized Account Holder: In the event of a dispute as to the identity of any Entrant, the authorized account holder of the email address or social media account submitted at time of entry will be deemed to be the Entrant. The “Authorized Account Holder” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address. Any potential winner may be required to show proof of being the authorized account holder to Sponsor.

WINNER SELECTION: One Grand Prize winner will be selected in a random drawing conducted by Sponsor or its affiliates from among all eligible entries received during the Entry Period. The odds of winning will depend on the number of eligible entries received during the Promotion Period. WINNER IS CONSIDERED “POTENTIAL” WINNER PENDING VERIFICATION OF ELIGIBILITY BY SPONSOR, WHO’S DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES.

Notification/Verification:  Potential winner(s) will be notified by Sponsor via email within 1-3 business days from the date in which the random drawing takes place (“Email Notification”) and/or messaged directly on social media platforms in which a Sweepstakes was hosted, if applicable. Winner will be required to provide name, email address and shipping address, if applicable, and any other relevant information connected with the Sweepstakes. Potential winner is subject to verification of the Entrant’s eligibility and compliance with these Official Rules, and may, at the Sponsor’s discretion, be required to provide Sponsor with documentation of eligibility and compliance with these Official Rules (ie: driver’s license). Failure to provide such proof in a timely manner may result in disqualification. The potential winner will be required to confirm prize acceptance within 72 hours of Sponsor’s initial notification attempt. If a selected winner cannot be contacted, notification attempts returned undeliverable, fails to claim the prize within 72 hours of initial notification, or fails to complete, sign and return applicable eligibility and verification documents (if requested), or prize is rejected by potential winner or cannot be accepted or received for any reason, or in the event of noncompliance with these Official Rules and requirements, the potential winner will be disqualified and prize will be forfeited. Prizes that are unclaimed, unredeemed, or returned as undeliverable will not be awarded. Upon prize forfeiture, no compensation will be given. 

Alternate Winner: In the event that a potential winner is disqualified for any reason, the Sponsor will award the applicable prize to an alternate winner from among the remaining eligible entries (in which case the foregoing provisions will apply to such newly-selected Entrant). Only one (1) alternate selection will be held, after which time a prize will not be awarded. Except as otherwise set forth herein, unclaimed Prizes will not be awarded. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER AT SPONSOR‘S SOLE DISCRETION WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Prize Restrictions: Only one prize per person and per household will be awarded. Prizes are non-assignable and non-transferable, and cannot be redeemed for cash. Substitutions are prohibited except at the sole and absolute discretion of Sponsor if a prize becomes unavailable or cannot be awarded, in whole or in part, for any reason, in which Sponsor can award a substitute prize of equal or greater value. Promotional pictures of prize(s) online, printed, or other Sweepstakes materials are for illustrative purposes only. All prize details that are not expressly specified in these Official Rules will be determined by Sponsor in its sole discretion.

Taxes: ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER. An IRS Form 1099 will be issued for prizes valued at $600 or more, as required by law.

Approximate Retail Value: The prize retail value may differ at the time of award. The Approximately Retail Value (“ARV”) of the prize represents Sponsor’s good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the prize turns out to be less than the stated ARV, the difference, if any, will not be substituted or awarded.

PRIZES ARE AWARDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND. Sponsor will not repair, replace, resend or reissue any late, lost, damaged, stolen, undeliverable or returned prize items, electronically or physically. In no event will more than the stated number of prizes be awarded. Restrictions, conditions, and limitations may apply. Failure to comply with the Official Rules will result in forfeiture of the prize. Sponsor shall not be held responsible for any delays in awarding the prize for any reason.

RIGHTS OF PUBLICITY: Except where prohibited, participating in Sweepstakes constitutes Entrant’s permission without further notice or consent, to the Sponsor’s and its affiliates use of Entrant’s name, likeness, social media username/handle, voice, statements, prize information, hometown and/or state for advertising, informational, trade or promotional purposes in all media now known or hereafter discovered, worldwide in perpetuity without further payment or consideration, INCLUDING THE USE IN A PUBLICLY AVAILABLE WINNER’S LIST. You further understand that Sponsor and their respective affiliates may also be required to disclose the winner’s full name, address or other personal information to state regulatory authorities as required by law.

OTHER SWEEPSTAKES: By entering a Sweepstakes, you will not be automatically entered into or eligible to participate in or receive any prize(s) awarded in any other Sweepstakes. In order to enter multiple Sweepstakes, you must enter each Sweepstakes separately in accordance with the respective Sweepstakes’ entry and eligibility requirements.

RELEASE; LIMITATIONS OF LIABILITY: By participating in this Sweepstakes, Entrants agree that the Sponsor, Promotion Entities, affiliates, prize suppliers, fulfillment services, all other companies and websites involved in the development or operation of the Sweepstakes, [Instagram, Inc., Facebook, Inc., Twitter Inc.] and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors, any and all Internet servers and access providers (collectively, the “Released Parties”) are not responsible for: (a) illegible, lost, late, forged, delayed, damaged, destroyed, inaccurate, incomplete, unanswered, postage due, unintelligible, non-delivered, misdirected, garbled, or stolen entries, comments, posts, emails, direct messages, replies, mail, or communications, or correspondence of any kind; (b) any technical, computer, mechanical, printing, typographical, human or other error; (c) lost, interrupted or unavailable network/service provider, server, website, or other connections, availability or accessibility or miscommunications, traffic congestion, or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or corrupt, jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (d) the incorrect or inaccurate capture of registration information or the failure to capture, or loss of, any such information; (e) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, viruses, theft or destruction or unauthorized human and/or mechanical access or intervention; (f) the security or privacy of information transmitted via computer networks, including any breaches of privacy due to interference by a third party, including third party computer “hackers” or otherwise; (g) damage to any computer system relating to or resulting from participation in or accessing or downloading any material in connection with the Sweepstakes; (h) any injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrants participation in the Sweepstakes or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). Further, Released Parties are not responsible for any unanswered or undeliverable winner notifications.

By entering the Sweepstakes, each Entrant agrees for Entrant and their heirs, executors, and successors (a) to be bound by these Official Rules and to waive any right to claim any ambiguity or error therein or in the Sweepstakes itself; (b) to be bound by all decisions of the Sponsor, which are binding and final; (c) to waive all rights to bring any claim, action or proceeding of any kind whatsoever against any of the Released Parties in connection with the Sweepstakes; (d) to forever and irrevocably agree to release, defend, indemnify and hold harmless each of the Released Parties from and against any and all claims, lawsuits, judgments, causes of action, proceedings, demands, fines, penalties, liability, or costs and expenses whatsoever (including without limitation, reasonable attorney fees) that may arise in connection with: (1) any Sweepstakes-related activity or element thereof, and the Entrant’s entries, participation or inability to participate in the Sweepstakes; (2) claims concerning infringement or invasion of privacy, misappropriation, defamation, personal, publicity or propriety rights, copyright or trademark rights, or merchandise delivery ; (3) injuries, losses or damages or demands of any kind (including without limitation personal injuries, death, damage to, loss or destruction of property); (4) acceptance, receipt, travel related to, participation in, delivery of, possession, defects in, use, non-use, misuse, inability to use, loss, damage, destruction, negligence or willful misconduct in connection with the use of a prize (or any component thereof); (5) any allegation of a violation of the laws, rules or regulations relating to personal information and data security; (6) any change in the prizing (or any components thereof); (7) human error; (8) any wrongful, negligent, or unauthorized act or omission on the part of any of the Released Parties; (9) lost, late, stolen, misdirected, damaged or destroyed prizing (or any element thereof); (10) the negligence or willful misconduct by Entrant; (11) the collection, use and/or sharing of Entrant’s personally identifiable information by Sponsor or its designees. (e) Entrant acknowledges that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, including those provided by the prize manufacturer, supplier, or any other entity.

IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE PRIZE AND/OR THE SWEEPSTAKES, DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATED WITH THE SWEEPSTAKES. THIS SWEEPSTAKES AND ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON INFRINGEMENT.

FORCE MAJEURE: The failure of Sponsor to comply with any provision of these Official Rules due to any event beyond their control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other “force majeure” event will not be considered a breach of these Official Rules.

DISPUTES; GOVERNING LAW: This sweepstakes is governed by the laws of the United States of America and the state of Florida, without respect to conflict of law doctrines. As a condition of participating in this sweepstakes, except where prohibited, participant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Sarasota County, Florida. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of the Sponsors in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the state of Florida, without giving effect to any choice of law or conflict of law rules (whether of the state of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of Florida. In any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages and any other damages, other than participant’s actual out-of-pocket expenses, if any (i.e. costs associated with entering this Sweepstakes), but in no event lawyers’ fees. Participant further waives all rights to have damages multiplied or increased.

SEVERABILITY: If any provision of these Official Rules is determined to be invalid or otherwise unenforceable or illegal, the remaining provisions of these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or unenforceable or illegal provision was not contained herein. If any term of these Official Rules is held to be excessively broad or invalid, illegal, or unenforceable in any jurisdiction, it shall be reformed and construed by limiting and reducing it so as to be enforceable to the maximum extent permitted by Applicable Law in conformance with its original intent.

RELEASE OF SOCIAL NETWORKS: Participant acknowledges that the Sweepstakes is in no way sponsored, endorsed, administered by, or associated with, Facebook Inc., Instagram Inc., Snapchat Inc., Twitter Inc., or any other third party website or application that may be used in connection with the Sweepstakes, along with the owners, parent companies, or subsidiaries of any of the above (collectively, the “Social Networks”), and fully releases and holds harmless all Social Networks, named or un-named, from any responsibility derived from the development of this Sweepstakes.

MISCELLANEOUS: These Official Rules contain the full and complete understanding with respect to the Sweepstakes and supersede all prior and contemporaneous agreements, representations, and understandings. The headings herein are for convenience only, do not constitute a part of these Official Rules, and shall not be deemed to limit or affect any of the provisions hereof. In the event of any discrepancy between these Official Rules and any Sweepstakes information provided elsewhere (including but not limited to advertising or marketing materials), these Official Rules shall prevail and govern the Sweepstakes.

PRIVACY: The collection of personal information supplied by you will be subject to our Privacy Policy at https://www.bookerybliss.com/policies/privacy-and-cookie-policy Information collected from Entrants is used only for the purpose of verifying eligibility, notifying the winner, administration and prize fulfillment by Sponsor or its Promotion Entities and affiliates, and will not be sold or shared in any other manner by Sponsor unless Entrant has opted-in to receive additional information and marketing or promotional material from Sponsor or another third party. By participating in the Sweepstakes, you hereby agree to the collection and usage of your personal information and acknowledge that you have read and accepted the Privacy Policy in it’s entirety.

Promotional Emails: You may be asked for consent to receive promotional emails and reminders for upcoming promotions and information about BookeryBliss or other third party sponsors. Consenting to receive such emails is optional and electing to receive promotional emails does not improve your chances of winning. You can unsubscribe to any promotional email by clicking on the “unsubscribe” link located at the bottom of the emails at any time.
